Elastisitas Syari'at Islam Dalam Perubahan Sosial

This study aims to examine the flexibility of Islamic law amidst of social change. It thus attempts to describe a comprehensive nature and character of Islamic law texts and to analyze the factors that shari'a can be relevance for social change. This paper is a descriptive qualitative research using a multidisciplinary approach which included a normative juridical approach, beneficiaries, and sociological approach. This study shows that the content of the shariah text is inclusive so it is possible to always re-interpret it. There are several factors causing Shari'ahto become dynamic and relevance to adapt into new environment. First, there are a number of religion issues being not described on its legal status. Secondly, generally syari'ah texts explain any issue totally. Third, the texts of religion generally have many “multiple interpretations”. Fourth, the Islamic laws consider emergency and force majure (istis|nai) conditions. Fifth, Islamic law is elastic, subjects can be changed depend on the time, place, and situation.Therefore, the understanding of syari'ah texts must be continuously maintained with respect to environment where mujitahid live. So the mujtahid can elaborate various interpretations of shari'ah text as a result of the influence they received from the time and their environment
