This study attempts to answer this question through the example of Gustav Radbruch (1878-1949), legal philosopher, but also Social-Democratic activist, supporter of the Republic and for some time Member of Parliament and Justice Minister. Even though he is not as well-known as Hans Kelsen or Carl Schmitt,, Radbruch participated in all the important legal debates of his time – debates which reflected the most significant issues of that time of crisis, the Weimar Republic.
