Analysis of the readiness of Serbia to effectively comply with and implement the European Timber Regulation (EUTR)

Illegaler Holzeinschlag und der Handel mit Holzprodukten aus illegal genutztem Holz sind globale Probleme. Es wurden verschiedene Maßnahmen ins Leben gerufen, um Holz aus illegalem Einschlag von Märkten möglichst auszuschließen, unter anderem die Europäische Holzhandelsverordnung. Diese Studie befasst sich mit der Frage, in welchem Maße die rechtlichen und administrativen Regelungen sowie die Kapazitäten von Behörden und Unternehmen des Forstsektors Serbiens derzeit schon für eine effektive Umsetzung der EU Holzhandelsverordnung bereit sind bzw. wären. Zur Klärung dieser Frage werden die wesentlichen Aspekte des Problemfeldes durch die Analyse relevanter Gesetze und Studien sowie auf Basis von Experteninterviews ausführlich beleuchtet. Die Inhaltsanalyse der dafür bedeutsamsten Regulierungen und die Ergebnisse der Expertenbefragungen zeigen die Lücken und Herausforderungen auf, die es in Zukunft zu schließen gilt, wenn die serbische Forstwirtschaft und Holzindustrie den Anforderungen der EU-Holzhandelsverordnung gerecht werden soll. Die Arbeit endet mit dem Vorschlag einiger konkreter Maßnahmen zur Anpassung der rechtlichen Grundlagen, der administrativen Abläufe und Kapazitäten sowie der Prozesses in der serbischen Forstwirtschaft, der serbischen Holzindustrie und im serbischen Holzhandel.Illegal logging and related trade have been recognised as significant global problems of the forest and wood industry sectors. Various measures have been introduced for excluding products based on illegal logging from the markets; inter alia, the European Union Timber Regulation (EUTR). This study assesses the state of readiness of the Serbian regulatory and administrative arrangements as well as of the management procedures of Serbian forestry and wood industry to comply with and to effectively implement the EUTR. In order to approach the complexity of the subject matter of illegal logging and related trade, this study starts out by reviewing the state of the art literature and the relevant European regulations for deducing the main dimensions of the problem field and the state of the EUTR implementation. The study continues with the case study description, portraying the current state of Serbian forestry and wood industries, particularly with regards to the issue of illegal logging and related trade. A content analysis of most relevant Serbian regulations and the results of a series of the in-depth expert-interviews allow to identify main gaps and challenges to harmonise the legislative framework and to adjust the organizational arrangements in the Serbian forestry and wood industry sector for effectively comply with the EUTR. For reflecting on the findings from the Serbian case study, this study also briefly gathered empirical data on opinions of Austrian experts concerning the challenges of adjusting for EUTR compliance and implementation. The results indicate gaps and weaknesses in the Serbian arrangements for avoiding illegal logging and related trade and stress the key challenges that are awaiting Serbia.
