The legal situation of former landowners in the Third Polish Republic

Dekret PKWN w sprawie tzw. reformy rolnej z 6 września 1944 r. miał przede wszystkim znaczenie polityczne, a jego wprowadzenie, niezależnie od wprowadzonych nim zmian w strukturze agrarnej na polskiej wsi, służyło głównie przejęciu władzy w Polsce przez komunistów po zakończeniu II wojny światowej. Tzw. reforma rolna doprowadziła do likwidacji grupy społecznej właścicieli ziemskich. Pomimo upływu ponad 70 lat od wprowadzenia dekretu nadal pozostaje wiele zasadniczych wątpliwości co do skutków prawnych jego wprowadzenia. Orzecznictwo Sądu Najwyższego, Trybunału Konstytucyjnego i Naczelnego Sądu Administracyjnego wątpliwości te pogłębia. W artykule przedstawiono krytykę tego stanu rzeczy a także zaproponowano wykładnię stosownych przepisów prawa dla jednoznacznego i jasnego określenia sytuacji prawnej byłych właścicieli ziemskich i ich spadkobierców.The Polish Committee of National Liberation’s Decree on Land Reform of 6 Sep- tember 1944 was of principally political signi cance and the adoption thereof, irrespective of changes made to the agrarian structure in existence theretofore in the Polish countryside, served primarily to facilitate the seizure of power in Poland by communists following the conclusion of World War II. The Decree resulted in the elimination of the class of landowners. The fundamental rami cations of the decree are yet to be unequivocally explained, and doubts keep abounding. The case law of the Supreme Court, the Constitutional Court and the Supreme Administrative Court only deepens the sense of uncertainty. The paper o ers a critique of the cases and proposes a novel method of construction of relevant legal norms so that the current legal situation of former landowners or their heirs may be clearly determined
