International audienceThe French Civil Code, since June 2013, allows same-sex couples to marry, to adopt jointly, and to resort to the adoption of the spouse’s child. Despite these considerable changes in French family law, the Civil Code do not take on board all the situations. This is the case, for example, when two women resort to assisted reproduction with sperm donation or when two men resort to a gestational surrogacy, all of these couples having jointly developed the project of starting a family. Same-sex couples who start a family are confronted with what they consider as legal deficiencies and with public decrying of their legitimacy to be recognized as full-fledged families.
