Les inventeurs de la tradition « melk » et « arch » en Algérie

International audienceWe can use the notion of « invented tradition » for two land categories which have been regarded for a long time, in Algeria (and in the Maghreb in general), as pre-colonial: private property or milk (« melk » in the French transcription) and “tribal” property or ʿarš (transcribed « arch »). However, their “recognition” comes from the 1863 imperial law which aims at getting closer native land rights and French law. It is obviously determined by the colonial project, the post-revolutionary experience in France, the expected guarantees in positive law from a land register (final goal of the reform). But the Saint-simonian sensitivity, the evaluation of the forces in presence and the lack of means also compel to a compromise between colonial interests and native rights. The reform commissioners add their own regard during its application which consists for them to transform irreducible anthropological realities within unvarying legal categories. The “tradition” is then strengthened at the end of the XIXth century and during the first half of the XXth century by the acceleration of the colonial land seizure which reconsiders these “recognized” rights. Jurists, historians, beneficiaries, even the Algerian State after the independence, contribute to it in their own way. To such an extent that there is finally a large consensus about the pre-colonial existence of both “arch” and “melk” properties.La notion de « tradition inventée » peut s’appliquer à deux catégories foncières qui, en Algérie (et plus généralement au Maghreb), ont été longtemps considérées comme précoloniales : les biens privés milk (ou « melk » dans la transcription française) et les biens de « tribu » ʿarš (« arch »). Leur « reconnaissance » résulte pourtant du sénatus-consulte de 1863 visant à rapprocher les droits fonciers autochtones de la loi française. Elle est évidemment conditionnée par le projet colonial, des représentations importées, l’expérience post révolutionnaire en France et les garanties attendues en droit positif d’un cadastre parcellaire (objectif final de la réforme). La sensibilité saint-simonienne, l’évaluation des rapports de forces et le manque de moyens contraignent cependant à un compromis entre les intérêts coloniaux et les droits autochtones. De leur côté, les commissaires de la réforme ajoutent leurs biais de lecture dans l’opération qui consiste à faire entrer dans des catégories juridiques uniformes des réalités anthropologiques irréductibles. Mais la « tradition » est consolidée à la fin du XIXe siècle et dans la première moitié du XXe siècle par la colonisation à outrance qui remet en cause ces droits fonciers « reconnus ». Des juristes, historiens, ayants-droit, et même l’Etat algérien après l’indépendance, y participent chacun à leur manière. Au point qu’il finit par y avoir consensus sur la réalité précoloniale des biens « arch » et « melk »
