Subjects of Appeal of the Sentence on the Basis of Agreement according to the Criminal Procedural Code of Ukraine

Attention is displaced on contradictions of norms of the Criminal Procedural Code of Ukraine, one of that gives a right on the appeal of the sentence on the basis of agreement only to the defendant (to his defender, legal representative) and public prosecutor from the clearly regulated grounds, and the other — straight and simply is about the right on the revision of sentence, that touches rights, freedoms or interests of face of cramps of higher level by any person, regardless of the participation in a judicial trial. The author proves that companions in a crime, criminal realization in relation to that is distinguished separately though not adopted straight as legal subjects on appellate but /whether appeal, however have the marked right. In fact the competition of such norms must be settled on behalf of the norm that regulates general principles of realization in criminal cases = Звернуто увагу на суперечності норм КПК України, одна із яких надає право на оскарження вироку на підставі угоди лише обвинуваченому (його захиснику, законному представнику) та прокурору із чітко регламентованих підстав, а у іншій — прямо та однозначно йдеться про право на перегляд вироку, що стосується прав, свобод чи інтересів особи судом вищого рівня будь-якою особою, незалежно від того, чи брала вона участь у судовому розгляді. Автор доводить, що співучасники злочину, кримінальне провадження щодо яких виділено окремо, хоч і не названі прямо як суб’єкти права на апеляційне та /чи касаційне оскарження, все ж мають зазначене право. Адже конкуренція зазначених норм має бути вирішена на користь норми, яка регламентує загальні принципи провадження у кримінальних справа
