Alternative Resolution of Criminal Legal Conflicts in the Legislation of the Republic of Belarus

The development of modern criminal justice is characterized by the search of the most effective mechanisms not only combating crime, but also to maximize the protection of the rights and legitimate interests of victims, promotion of positive post-criminal behavior of the accused, including on compensation for crime damage (damage). The successful solution of these tasks is not always possible to achieve within the traditional system of justice by bringing the guilty to criminal responsibility and punishment. In this regard, the article discusses alternatives for the state’s response to the crime, the grounds and conditions of their application under the legislation of the Republic of Belarus. These alternative procedures include institute of termination of the proceedings to the exemption from criminal liability. A partial alternative to criminal prosecution can be considered such conciliation (compromise) procedure as an abbreviated procedure for the judicial investigation, the absentia proceedings in the court and pre-trial agreement on cooperation = Развитие современного уголовного судопроизводства характеризуется поиском наиболее эффективных механизмов не только противодействия преступности, но и максимальной защиты прав и законных интересов потерпевших, стимулирования позитивного посткриминального поведения обвиняемого, в том числе по возмещению причиненного преступлением вреда (ущерба). Успешного решения этих задач не всегда удается достичь в рамках традиционной системы судопроизводства путем привлечения виновного к уголовной ответственности и его наказания. В связи с этим в статье обсуждаются альтернативные способы реагирования государства на совершённое преступление, основания и условия их применения по законодательству Республики Беларусь. К этим альтернативным процедурам относится институт прекращения производства по делу с освобождением от уголовной ответственности. Частичной альтернативой уголовному преследованию можно считать такие согласительные (компромиссные) процедуры, как сокращенный порядок судебного следствия, заочное производство и досудебное соглашение о сотрудничеств
