The Act provides a qualified privilege against compelled disclosure of information for those who gather and disseminate news. The privilege applies only in proceedings in which the one asserting the privilege is not a party. The privilege is not absolute; to overcome the privilege the party seeking the information must show that the information sought is material and relevant, cannot be reasonably obtained by other means, and is necessary to the proper preparation or presentation of the case of the party seeking the information
