Kedudukan Hukum Anak Tidak Sah Sebelum dan Setelah Putusan Mahkmaah Konstitusi Nomor 46/puu/vii/2010

Child are generation who are the continuer of nation. Every child have the self respect and honor. Those are respected highly. Every child, who had been born, had to get their right automatically. The Child need to be protected and a guarantee in fulfiling for their right and non discrimination manner of dealings. But in fact, most of the child are not get their right yet, aspecially unlawful child. This is mentioned in article 43 subsection (1) the law of marriage, that the child who are born before marriage, are not have the condition of being civil law relationship with the father. The Contitution Justice Court had been adjudicate, that beside of the child have the condition of being civil law relationship with the mother and the mother\u27s family, they also have the condition of being civil law relationship with the father and the father\u27s family as long as they can to proof scientifically
