Decisions of judges at each court level can reflect the quality, integrity, speed, accessibility, and consistency of reasoning judges. However, actual conditions, the judicial system in Indonesia is still far from expectations. The justice system can not be considered law enforcement function (law enforcement) and the loss of public confidence (public trust), especially the search for justice (fair trial seeker). Decision Number: 25/Pid / 2010/PT Sby as an object of this research is more oriented to the fulfillment of the formal aspects of legal certainty, as required under the Criminal Code but has not been able to achieve procedural justice and substantive justice. This is clearly illustrated that the judges are still ignoring the rules of fair trial and due process of law as well as in building construction law ignores the facts that appear in the court of law as well as non-judicial aspects of other, especially not accommodate the values of respect for human rights as the right- constitutional rights of the people.Keywords: procedural justice, substantive justice, judicial decisionABSTRAKPutusan hakim adalah produk utama pengadilan. Putusan hakim di setiap tingkat pengadilan dapat mencerminkan kualitas, integritas, kecepatan, aksesibilitas, dan konsistensi penalaran hakim. Namun demikian kondisi senyatanya, sistem peradilan di Indonesia masih jauh dari harapan. Sistem peradilan dinilai belum bisa menjalankan fungsi penegakan hukum (law enforcement) dan semakin kehilangan kepercayaan masyarakat (public trust) khususnya pencari keadilan (fair trial seeker). Putusan Nomor: 25/Pid/ 2010/PT Sby sebagai obyek penelitian ini lebih berorientasi pada pemenuhan aspek kepastian hukum formil sebagaimana disyaratkan dalam KUHAP namun belum dapat mewujudkan keadilan prosedural dan keadilan substantif. Hal ini tergambar jelas bahwa hakim masih mengabaikan kaidah fair trial dan due process of law serta dalam membangun konstruksi hukum mengabaikan fakta- fakta hukum yang muncul di persidangan serta aspek-aspek non yuridis lainnya seperti masih terabaikannya penghormatan nilai-nilai Hak Asasi Manusia sebagai hak-hak konstitusional rakyat.Kata Kunci : keadilan prosedural, keadilan substantif, putusan haki
