Perlindungan Hukum terhadap Tenaga Kerja Indonesia (Tinjauan terhadap UU Nomor 39 Tahun 2004 Tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia)

Perlindungan terhadap tenaga kerja Indonesia yang bekerja di luar negeri merupakan bagian dari kewajiban negara untuk memenuhi hak-hak konstitusional sebagai warga negara. Undang-Undang Nomor 39 Tahun 2004 Tentang Penempatan dan Perlindungan Tenaga Kerja Indonesia merupakan bagian integral dari sistem yang dibangun berdasarkan amanat Pasal 28 D ayat 3, dimana setiap warga negera berhak untu mendapatkan pekerjaan yang layak. Artinya bahwa hak yang dimiliki setiap warga negera merupakan hak untuk bekerja di luar negeri dan kewajiban negara untuk memberikan perlindungan terhadap tenaga kerja Indonesia yang bekerja di luar negeri. Abstract The protection of Indonesian workers who work abroad are part of the States obligation to fulfill the constitutional rights as citizens. Law No. 39 Year 2004 on the Placement and Protection of Indonesian Workers are an integral part of the system that builds upon the mandate of Article 28 subsection 3D, where every citizen has the right country to get a decent job. This means that the rights that every citizen of the country is the right to work outside the country and the states obligation to provide protection for Indonesian workers who work abroad.
