Abstract: Unreasonable, unconscionable and oppressive contract terms have for a long time been a subject of concern. In South Africa, the matter enjoyed the attention of the South African Law Commission and their recommendations regarding unreasonable, unconscionable and oppressive contract terms had the potential to adddress some of the concerns associated with these terms. However, instead of implementing the recommendations of the Commission in toto, the Consumer Protection Act 68 of 2008 was implemented in April 2011 and addressed only a number of concerns raised by the Law Commission.
