This paper discusses the heated debates that took place in England in the second half of the 19th century about the importation of the French model of "tribunals of commerce" (special commercial courts with merchant judges). Although this proposal was finally rejected, this failure cannot simply be dismissed as the product of an enduring "legal tradition" or of a conflict between the preferences of lawyers and merchants.
