Etat de droit et états d'exception. Une conception de l'Etat

In a public law and political philosophy perspective, this book intends to uphold the theory that a dialectical tension exists between two notions, which, seemingly antinomic, are nevertheless linked, and therefore interactive: on the one hand, the 'State of law', a political finality, which is the very goal of the State, and which requires separation of powers and protection of rights (the State of law has to be distinguished from the rule of law and the Rechtsstaat) ; on the other hand, the states of exception, juridical techniques at the State's disposal, which allow for concentration of powers and limitation of rights. Indeed, regimes of exception presuppose a normality, - that is the authority of the State, and the will of a State of law -, to be recognized as methods serving political society. The State needs to admit and employ states of exception, with the aim of detaining the prerogative which is necessary to create and preserve its own sovereignty, so as to become a State of law. The means take an active part in reaching the objectives for which the State devises them: they facilitate the foundation of the State of law. The means help to appreciate the characteristics of the State which uses them: they reveal to what extent the State of law has been achieved. In order to deal with such an interaction between the State of law and the states of exception, a both logic and genealogic approach is proposed. A history of the conception of the State is exposed, through the prism the relation between norms and exceptions offer. The way the Roman dictatorship, the reason of State, the sovereign Leviathan, and the democratic theory have contributed to enrich the couple State of law / states of exception is analysed. So the fundamental elements of the relation between these two parts are enlightened. Efficacy, reality, stability and effectiveness appear to have presided to the emergence and the permanence of the modern State. Some examples are exploited to underline the interest such an approach presents. They are found in history, especially the one of France, Great-Britain, United-States, Central and Oriental European countries. So the current tension between fundamental rights protection and home security preoccupations is enlightened; so the hindrances the fight against terrorism and the migratory flows management arise can be understood.Dans une perspective alliant droit public et philosophie politique, l'ouvrage traite de la tension dialectique entre deux notions qui semblent antinomiques, pourtant indissociables, partant interactives : d'une part, l'Etat de droit, finalité politique à l'horizon de l'Etat, qui requiert séparation des pouvoirs et garantie des droits ; d'autre part, les états d'exception, techniques juridiques au service de l'Etat, qui autorisent concentration des pouvoirs et restriction des droits. Car les états d'exception supposent une normalité, - l'autorité d'un Etat et la volonté d'un Etat de droit -, pour être reconnus comme moyens au service du corps politique ; car l'Etat réclame l'admission et l'utilisation de régimes d'exception pour détenir la puissance nécessaire à la création et conservation de sa souveraineté, afin d'atteindre à l'Etat de droit. Les moyens participent de la réalisation des objectifs pour lesquels l'Etat les conçoit : ce sont des vecteurs de fondation de l'Etat de droit ; ils permettent la manifestation des qualités de l'Etat qui les emploie : ce sont des révélateurs du degré de réalisation de l'Etat de droit. Afin de saisir l'interaction entre Etat de droit et états d'exception, une démarche à la fois logique et généalogique est proposée. Elle se permet d'exposer une histoire de la conception de l'Etat à travers le prisme offert par la relation entre droit et exceptions : sont donc abordés les apports respectifs de la dictature de la république romaine, de la raison d'Etat souveraine, de la pensée libérale, de la théorie démocratique. Ce faisant, apparaissent des principes essentiels à la compréhension du couple Etat de droit / états d'exception en ce qu'ils président à la naissance et la permanence de l'Etat. Efficacité, réalité, stabilité, effectivité : tels sont les quatre principes qui sont saisis et traités. A la faveur d'exemples, est mis en évidence l'intérêt de ce regard porté sur l'Etat au travers de la tension entre normes et exceptions. Des illustrations sont tirées de l'histoire, qu'il s'agisse de celle de la France, de la Grande-Bretagne, des USA, des PECO. Elles sont également issues de l'actualité qui redonne vigueur à la problématique Etat de droit / états d'exception, sous couvert le plus souvent d'une opposition entre protection des droits fondamentaux / préservation de la sécurité intérieure : ainsi des mesures adoptées au titre de lutte contre le terrorisme, ou de la gestion des flux migratoires
