Illegally Obtained Property and its Actual Problematics in Criminal Procedure

Bakalaura nosaukums ir ,,Noziedzīgi iegūtas mantas kriminālprocesuālais regulējums un problemātika”. Bakalaura darba mērķis ir izanalizēt literatūru, veikt izpēti un atrast noziedzīgi iegūtas mantas institūta problemātiku, noskaidrot kāda ir noziedzīgi iegūtas mantas piemērošana praksē. Tāpat arī viens no darba mērķiem ir piedāvāt normatīvajos aktos un tiesu praksē pastāvošajām problēmām risinājumus. Bakalaura darba uzdevums ir izpētīt noziedzīgi iegūtas mantas institūta rašanās vēsturi, salīdzināt dažādu tiesību zinātnieku viedokļus attiecībā uz šī institūta problemātiku, kā arī piedāvāt normatīvajos aktos un tiesu praksē pastāvošo problēmu risinājumus. Bakalaura darbs sastāv no trīs nodaļām. Pirmajā nodaļā autore analizē noziedzīgi iegūtas mantas institūta rašanās vēsturi, mantas jēdzienu uz izpratni, kā arī noziedzīgi iegūtas mantas jēdzienu, izpratni un rīcību ar to. Otrajā nodaļā autore pēta Latvijas tiesu praksi attiecībā uz noziedzīgi iegūtu mantu. Trešajā nodaļā tiek analizēta noziedzīgi iegūtas mantas un īpašuma civiltiesiskā aizsardzība.The title of the Bachelor thesis is ‘Illegally Obtained Property and its Actual Problematic in Criminal Procedure’. The aim of the Bachelor thesis is analyzing literature, making a research and finding problematics about illegally obtained property, clarifying the procedure of the illegally obtained property in case law. Either, one of the aims of the thesis is providing solution about the problematic in rules and case law. The task of the Bachelor is to explore the history of the illegally obtained property, compare different legal scholars’ point of view and provide the solution of the problematics in the procedure of the rules and case law. The Bachelor thesis consists of three chapters. In the first chapter the author analyzes the history of the illegally obtained property, the meaning and the concept of the property and illegally obtained property, the procedure of the illegally obtained property. In the second chapter the author explores the case law about the illegally obtained property in Latvia. The third chapter is about the illegally obtained property and the civil protection of the property
