This installment of the survey of litigation involving the Fund's Articles discusses four cases decided in England, France, the Federal Republic of Germany, and the State of New York in which the issues were related to the exchange control regulations of a member of the Fund other than the country of the forum. The New York case deals also with the enforcement of a Euro-dollar loan contract. The main issues that are discussed relate to Article VIII, Section 2(b). Some of the issues raised by the provision and the cases are whether the court must consider the effect of the provision even if the parties do not cite it, the meaning of "exchange contract," the meaning of "contrary" to exchange control regulations, the currency that is "involved...
