Pena utilitarista e vingança institucionalizada

The present study aims to clarify the origin of dysfunction within Latin American prison systems through a critical examination of criminal policies and punitive discourse adopted in the region. It reveals the dysfunctional nature of punishment as a utilitarian and vengeful measure. Initially, the main theories of punishment are analyzed, as well as their justifying functions for the exercise of punitive power. Then, the theoretical contradictions denouncing the exercise of this power as pure institutionalized revenge are addressed. To confirm the initial hypothetical propositions, data on criminal execution and its social consequences are analyzed considering the normative paradigm proposed by South American states, highlighting the need to readjust sanctioning practices in the reality of economically and socially developing countries. Finally, after identifying the limits that characterize the systemic and discursive dysfunction under analysis, initial proposals for readjustment between the intended reality (should be) and the current reality (is) are suggested.O presente estudo tem por objetivo esclarecer a origem da disfunção existente nos sistemas penitenciários latino-americanos, através do exame crítico de políticas criminais e do discurso punitivo adotado na região, revelando a natureza disfuncional da pena enquanto medida de caráter utilitarista e vingativo. Em princípio, são analisadas as principais vertentes das teorias da pena, bem como suas funções justificadoras do exercício do poder punitivo. Em seguida, são abordadas as contradições teóricas que denunciam o exercício desse poder como pura vingança institucionalizada. Para confirmar as proposições hipotéticas iniciais, são analisados dados relativos à execução penal e suas consequências sociais diante do paradigma normativo proposto pelos Estados sul-americanos, evidenciando a necessidade de readequação das práticas sancionatórias na realidade de países em desenvolvimento econômico e social. Por fim, identificados os limites que caracterizam a disfunção sistêmica e discursiva objeto de análise, são então indicadas propostas iniciais de readequação entre a realidade pretendida (dever ser) e a realidade atual (ser)
