La figura italiana de violenza sessuale di gruppo: ¿un modelo a seguir en España?

The punishment of gang rapes is a particularly problematic issue in Spain due to the lack of jurisprudential agreement on how these acts should be classified. Although there are some common premises – that in gang rapes there are at least as many typical acts of rape as there are different people who have carnal access to the victim and that all of them must be imputed to all the members of the group –, on some occasions the courts consider the continuous offence to be applicable, and on others they do not, in the latter cases considering the typical acts as individual offences. As a solution to this situation of legal uncertainty, some authors have been proposing the introduction of a multi-subjective offence of gang rape in the Penal Code, similar to that already existing in the Italian PC (art. 609-octies). This paper will reflect on the need and convenience of a reform of the PC that incorporates a figure of these characteristics.El castigo de las violaciones grupales constituye una cuestión especialmente problemática en España ante la ausencia de un acuerdo jurisprudencial sobre cómo han de calificarse estos hechos. Si bien se parte de unas premisas comunes –la de que en las violaciones en grupo concurren al menos tantas acciones típicas de violación como personas distintas accedan carnalmente a la víctima, y la de que todas ellas han de imputarse a cada uno de los integrantes del grupo–, en unas ocasiones los tribunales consideran aplicable el delito continuado, y en otras no, valorando en estos últimos casos las acciones típicas como delitos individuales. Como solución frente a esta situación de inseguridad jurídica, algunos autores vienen proponiendo la introducción en el CP de un delito plurisubjetivo de violación grupal, similar al ya existente en el CP italiano (art. 609-octies). En el presente trabajo se reflexionará sobre la necesidad y conveniencia de una reforma del CP que incorpore una figura de estas características
