El testigo experto: efectos de convicción para la decisión judicial en procesos de responsabilidad civil por error médico

A witness is a third party outside the dispute between the parties, who provides specific information as testimonial evidence. In this polysemic expression, with a shared nature and complementary evidentiary effects, there is, on the one hand, the so-called technical witness, connected to the case, relevant for his factual presence and his knowledge or mastery of knowledge related to the facts previous to the event. On the other hand, there is the expert witness, identified without a testimonial nature of his own, but who acquires this denomination when he intervenes to give explanations of his opinion through cross-examination. In another particular area, the participation of the expert is evidenced, but without the capacity of technical witness or expert witness, who provides his expertise to assist in the evaluation of evidence. This expert has been named a new means of evidence by the Supreme Court of Justice of Colombia. This article characterizes the evidentiary contribution of each of these experts in their procedural intervention, from the model of tort liability for medical error. Then the levels of conviction are outlined and analyzed, in the variables of plus, superior and medium or inferior, on which the judge can place himself to justify the decision argumentatively from the contribution of expert information to the process.Un testigo es un tercero ajeno a la controversia de partes que aporta información específica como prueba testimonial. En esta expresión polisémica, con naturaleza compartida y efectos probatorios complementarios, por un lado, aparece el denominado testigo técnico conectado al caso, relevante por su presencia fáctica y su conocimiento o dominio del saber relacionado con los hechos ex ante al evento; por otro lado, se identifica al testigo perito sin naturaleza testimonial propia, pero que adquiere esta denominación al intervenir para dar explicaciones del dictamen a través de interrogatorio cruzado. En otro ámbito particular, se evidencia la participación del experto, pero sin la calidad de testigo técnico ni perito testigo, quien aporta su experticia en auxilio a la valoración de la prueba. Este experto fue denominado nuevo medio de prueba por la Corte Suprema de Justicia de Colombia. En este artículo se caracteriza por aporte probatorio a cada uno de estos expertos en su intervención procesal, desde el modelo de responsabilidad civil extracontractual por error médico; luego, se esquematizan y analizan los niveles de convicción, en las variables de plus, superior y medio o inferior, sobre los que puede ubicarse el juez para justificar argumentativamente la decisión a partir de la aportación de información experta al proceso
