Vers une justice climatique transnationale et globale

International audienceClimate change and its governance is a multi-scalar problem, linked to and dependent on several scales: spatial or temporal. Climate litigation has diagonal qualities that facilitate transnational dialogue by helping Courts and decision-makers address the complex intersection of Law and climate change. This study looks at how Climate justice (Climate litigation) has become an international as well as a transnational dynamic, developing in the North and in the Global South. Climate litigation has particular characteristics in the Global South, and brings new features compared with the litigation movement in the North. The current trend is to bring Climate justice together in a single transnational movement, laying the foundations for a global construction.Le problème du changement climatique et de sa gouvernance sont multi-scalaires, liées à plusieurs échelles : spatiale ou temporelle et, dépendants d’elle. Les contentieux climatiques possèdent de qualités diagonales qui facilitent le dialogue transnational en aidant les tribunaux et les décideurs à s'attaquer à l'intersection complexe du droit et du changement climatique. Cette étude aborde comment la justice climatique (les contentieux climatiques) est devenue une dynamique internationale mais également transnationale se développant autant dans les pays du Nord dans ceux du Sud Global. Les litiges climatiques présentent de caractéristiques particulières dans les pays du Sud et apportent de nouveautés par rapport au mouvement contentieux du Nord. La tendance actuelle consiste à réunir en un seul mouvement transnational la justice climatique, posant ainsi les bases d’une construction globale
