La justicia transicional. un mecanismo para la reparación integral

Transitional justice had understood as a mechanism for the victims of serious human rights violations in such a way that they can access the different mechanisms of this diverse justice which are the right to truth, administration of justice, reparation, and guarantees of non-repetition, and the methodology of this research is qualitative because it is of histological and exegetical order. The objective aims to analyze transitional justice in Ecuadorian and Colombian law using comparative law because there is no transitional justice in Ecuador itself. The approach is qualitative due to the comparative law analysis and the functioning of transitional justice in Colombia. It is relevant to highlight the application of this justice system in Ecuador because the issue of truth commissions is not something isolated in the Ecuadorian legal system, but has been created previously with the idea of offsetting and identifying violent acts against the rights of individuals, fully repairing the victim and accessing the truth.La justicia transicional, puede ser entendida como un mecanismo para las víctimas de graves violaciones de derechos humanos de tal forma estas puedan acceder a los distintos mecanismos de esta diferenciada justicia que son: derecho a la verdad, administración de justicia, reparación y garantías de no repetición, por otro lado, la metodología de la presente investigación es cualitativa debido que es de orden historiológico y exegético. El objetivo es analizar la justicia transicional en la normativa ecuatoriana y colombiana a través del derecho comparado, porque dentro del Ecuador no existe como tal la justicia transicional es así que debemos realizar la comparativa con el Estado colombiano. El enfoque de este trabajo es cualitativo, debido al análisis de derecho comparado y funcionamiento de la justicia transicional en Colombia. Es importante destacar la aplicabilidad de este sistema de justicia en Ecuador, puesto que, para el ordenamiento jurídico ecuatoriano la temática de las comisiones de la verdad no es algo aislado, sino que han sido creadas con anterioridad con la idea de contrarrestar y delimitar los actos violentos contra el derecho de las personas, reparar íntegramente a la víctima y acceder a la verdad
