RESTRICTIONS ON RELIGIOUS ACTIVITIES IN THE TIME OF COVID-19 FROM THE PERSPECTIVE OF MAṢLAHAT MURSALAH

The Government of the Republic of Indonesia issued Large-Scale Social Restrictions (PSBB) regulations to reduce the spread of Covid-19 and also applies to religious activities. This article examines the forms of restrictions on religious activities based on Government Regulation (PP) Number 21 of 2020 from the perspective of maslahah mursalah. This study is juridical law research that uses primary legal materials, namely Government Regulation Number 21 of 2020, Regulation of the Minister of Health of the Republic of Indonesia Number 9 of 2020, Circular of the Ministry of Religion, and MUI Fatwa. Restrictions on religious activities are carried out by worshiping at home, keeping the distance for congregational prayers, and adhering to health protocols. From the perspective of maṣlaḥah mursalah, all of these regulations aim to protect the soul at the primary level (ḍarūriyyah)
