Sebagai negara pihak yang telah meratifikasi Konvensi Hak Anak, maka negara memiliki kewajiban umum (generic obligation) yaitu menghormati, melindungi dan memenuhi hak-hak anak, tanpa kecuali. Keberadaan anak-anak dalam tempat penahanan dan pemenjaraan bersama orang-orang yang lebih dewasa, menempatkan anak pada situasi rawan dan menjadi korban berbagai tindak kekerasan. Sudah semestinya, keadilan restoratif yang berkepastian hukum harus menjadi tujuan dalam penyelenggaraan peradilan anak.
