A Proteção dos Direitos dos Trabalhadores pela Corte Interamericana de Direitos Humanos

This scientific article aims to analyze the current protection of labor social rights under the Brazilian Constitution of 1988 and the Inter-American Human Rights System (IAHRS), with special emphasis on the Inter-American Court of Human Rights (IDH Court). The research problem consists of investigating the performance of the Inter-American Court in the protection of labor social rights. After exposing the importance of the 1988 Constitution for labor rights in Brazil and presenting the Inter-American System and its main documents for the protection of social rights, the deliberations of the Inter-American Court in cases and opinions about the labor were analyzed and labor standards were delimited in the following axes: a) prohibition of slavery, servitude, forced labor and practices similar to slavery; b) rights to work and to fair and satisfactory working conditions that guarantee the worker's safety, health and hygiene; c) women's labor rights; d) workers' union rights; e) impacts of new technologies on the labor market; f) labor rights of people with disabilities. It is argued that these labor standards must be observed by the signatory States of the American Convention on Human Rights (ACHR) and, in particular, by those who have accepted the contentious jurisdiction of the Inter-American Court, through the exercise of the conventionality control technique, under the north from principle to persona. The research carried out is of the exploratory type, with a deductive method of approach. As for the procedures, the research is bibliographical and documental.O presente artigo científico tem por objetivo analisar a atual proteção dos direitos sociais trabalhistas no âmbito do Sistema Interamericano de Direitos Humanos, com especial destaque para a Corte Interamericana de Direitos Humanos (Corte IDH). O problema de pesquisa consiste em averiguar a atuação da Corte IDH na tutela dos direitos sociais trabalhistas. Após a exposição da importância da Constituição de 1988 no fortalecimento dos direitos laborais no Brasil e realizada uma breve apresentação do surgimento do Sistema Interamericano e de seus principais documentos de proteção dos direitos sociais, analisa-se as deliberações da Corte IDH nos casos e nas opiniões consultivas referentes a temática trabalhista, delimitando-se os standards interamericanos laborais sistematizados nos seguintes eixos: a) proibição da escravidão, da servidão, do trabalho forçado e de práticas análogas à escravidão; b) direitos ao trabalho e a condições de trabalho equitativas e satisfatórias que garantam a segurança, a saúde e a higiene do trabalhador; c) direitos laborais das mulheres; d) direitos sindicais dos trabalhadores; e) impactos das novas tecnologias no mercado de trabalho; f) direitos laborais das pessoas com deficiência. Defende-se que tais standards interamericanos laborais devem ser observados pelos Estados signatários da Convenção Americana de Direitos Humanos e, particularmente, por aqueles que aceitaram a competência contenciosa da Corte IDH, mediante o exercício da técnica do controle de convencionalidade, sob o norte do princípio pro persona.
