Objective: to analyze the current interpretation of the constitutional rule of solidarity within the scope of the Brazilian Unified Health System (SUS), after the Supreme Court ruled in appeal judgment with precedent setting. Method: the deductive method was used to understand and interpret the meaning of solidarity and its practical consequences; and empirical-analytical method for analysis of the premises set by the Supreme Court. Results: we observed an approximation between the ground of precedent and the statements of statements 8 and 78, which are prior to the judgment of the appeal.
