Solar access: Review of the effective legal framework for an average argentine city

The present work aims to analyze the effective legal framework at the national, provincial and local levels regarding solar access for the city of Bahía Blanca. This analysis allowed us to identify existing legal potentials as well as gaps in the subject in order to implement local management measures in the context of global climate change. As a result, it could be observed that currently there are no specific laws in Argentina or in Bahía Blanca regarding access and right to the sun. This issue is indirectly implicated in national, provincial and even in municipal ordinances already implemented. The legislation analyzed focuses on three major groups. The first one includes the protection of the environment, climate change and sustainable development. The second group is made up of laws related to the promotion and development of clean energies, including photovoltaic energy production, throughout the national territory. The third group consists of regulations concerning morphological characteristics in public and private buildings, the building density at urban scale, land uses, etc.Fil: Fernández, María Eugenia.
