A Study of the Independence of Local Educational Administration -Espeially on the Enactment of School Management Regulations-

The New Board of Education Law, Art. 33, prescribes that each Board of Education shall make regulations concerning the fundamental matters of school management. But the prescription has been keenly disparaged by teachrs on the active List, chiefly because the effect of the article is liable to bring the control of education officials, violating the independence of Local Educational Administration. In fact, there is hardly any difference between the School Management Regulations prescribed by each Board of Education and the prefectural standing rules. In the present research the author studies where the resembrance above comes from, according to the course of and teachers' opinions to the enactment of the said regulations in S. city, a satillite-town, for an example. In S. City, except the regulations for daytime and night duty, the situations are the same as mentioned above : the regulations are prescribed in legal style, and the draft of the regulations are almost in accord with the standing rules. However, the question lies not in the forms or contents of the rules or the regulations, but in the course of their enactment on officialism. At the start of Board of Education Law there were pointed out inconsistencies about the independent character of Board of Education, which have come apparent through the shocking enactment of the regulations.
