This article aims to bring Inclusive Education based on the principle that every human being has the right to study in a regular school. The methodology adopted was the qualitative one of bibliographic and documentary nature. As a general objective, it was outlined: to analyze how the current Educational Legislation can contribute to the guarantee of access and permanence of students with Special Educational Needs or with disabilities in Regular Education. As specific objectives: List stories of inclusion and overcoming present in contemporary society; to verify how the challenge of guaranteeing access and permanence in the educational context has been; reflect on teaching practice in the context of inclusion.
