PEMENUHAN HAK ATAS PENDIDIKAN BAGI ANAK BINAAN PADA LEMBAGA PEMASYARAKATAN KELAS IIA BOGOR

Child prisoners are children who are undergoing a criminal period in a Correctional Institution. During the period of imprisonment in Correctional Institutions, of course, the right to education for child prisoners is still attached to them. The right to education for child prisoners has indeed been regulated in Law No. 22 of 2022 concerning Corrections Article 12 point (c). The granting of education rights for child prisoners is in line with the goals of the penitentiary, namely social reintegration. This research was conducted to find out objective conditions related to the fulfillment of the right to education for assisted children that occurred in Lembaga Pemasyarakatan Kelas IIA Bogor. This research was conducted with a sociological juridical approach and literature study. The results of this study found that the education program for child prisoners who were placed in Lembaga Pemasyarakatan Kelas IIA Bogor had been implemented quite well, but not yet optimal. child prisoners only get non-formal education. child prisoners have not been able to get their rights to formal education because the program is not yet available. Apart from that, the implementation of the coaching and education programs carried out in Lapas Bogor is still constrained by the existing facilities and infrastructure and the lack of human resources for implementing the coaching and education programs. In fact, the target children should be placed in the LPKA (Lembaga Pemasyarakatan Khusus Anak), but because the families of the target children do not agree if the child prisoners are transferred, they agree that the child prisoners will remain in the General Correctional Institution without fulfilling their right to formal education
