The article aims to discuss the progressive adoption of the right to education by the Brazilian State in the Federal Constitutions from 1824 to 1988 and in the Law of Directives and Bases of National Education (LDB/Law nº 9.394) of 1996, in opposition to social and political policies contemporary educational activities that limit the enjoyment of this fundamental right, such as Constitutional Amendment nº 95/2016, the Common National Curriculum Base (BNCC) and the High School Reform (Law nº 13.415/2017).
