Tutela dos direitos humanos dos migrantes em situação de vulnerabilidade: obrigações internacionais, políticas locais

The article aims to deepen the understanding of the necessary public policies to ensure the proper protection of migrants' rights, as advocated by International Law. To achieve this objective, specific goals were outlined, including the analysis of the relationship between International Law and public policies for migrants, the examination of relevant international norms governing the protection of migrants' human rights, and the understanding of the standard of protection sought by International Law for vulnerable migrants. The article's methodology includes documentary research based on the study of international legislations, as well as bibliographic research. It presents a comprehensive and well-founded analysis, supported by theoretical and legal foundations, on the necessary public policies to ensure the protection of vulnerable migrants' human rights. Finally, it concludes that while specific public policies for vulnerable migrant populations are essential and envisaged by International Law, the most critical action is to ensure access to general public policies for this group.O artigo objetiva aprofundar o conhecimento sobre as políticas públicas necessárias para garantir a devida proteção dos direitos dos migrantes, conforme preconizado pelo Direito Internacional. Para alcançar esse objetivo, foram delineados objetivos específicos, incluindo a análise das relações entre o Direito Internacional e as políticas públicas para migrantes, o exame de normativas internacionais relevantes que regem a proteção dos direitos humanos dos migrantes e a compreensão do padrão de proteção buscado pelo Direito Internacional para migrantes vulneráveis. A metodologia do artigo inclui pesquisa documental, baseada no estudo de legislações internacionais, bem como pesquisa bibliográfica. O artigo apresenta uma análise abrangente e fundamentada, respaldada por embasamento teórico e jurídico, sobre as políticas públicas necessárias para garantir a proteção dos direitos humanos dos migrantes em situação de vulnerabilidade. Por fim, conclui que, apesar de ser necessário implementar políticas públicas específicas para a população migrante em situação de vulnerabilidade, e que essas políticas são previstas no Direito Internacional, a ação mais importante é garantir para esse grupo o acesso às políticas públicas de um modo geral
