PEMIKIRAN MUHAMMAD IQBAL DAN PENGARUHNYA TERHADAP PEMBARUAN HUKUM ISLAM

Abstract: The Thoughts of Muhammad Iqbal and Its Influences on Law Reform in Islam. Muhammad Iqbalideas, especially in the renewal of Islamic Law in India, are heavily influenced by the social dynamics that occur among the people of Europe. Iqbal believes that ijtihad is the sole source to develop Islamic law which refers to the interests and the progress of the people. According to his understanding, the Qur’an and the Hadith as sources of ethics are able to adopt the dynamics of times. The Muslims, therefore, should be able to understand wholy and deeply the messages of the Qur’an and hadith in order to find a solution to social problems. Iqbal also see the importance of transfering the authority of individual ijtihâd to the collective ijtihâd (ijmâ‘).Abstrak: Pemikiran Muhammad Iqbal dan Pengaruhnya Terhadap Pembaruan Hukum Islam. Gagasan Muhammad Iqbal khususnya pada pembaruan hukum Islam di India banyak dipengaruhi oleh dinamika sosial yang terjadi di kalangan masyarakat Eropa. Iqbal merasa bahwa ijtihad merupakan kebutuhan yang sangat mendesak dalam mengembangkan hukum Islam yang mengacu kepada kepentingan umat dan kemajuan umum. Menurut Iqbal pemahaman terhadap Alquran dan Hadis sebagai sumber etika harus mampu mengadopsi dinamika perkembangan zaman. Untuk itu, umat Islam harus mampu memahami kandungan nash-nash Syara’ (Alquran dan Hadis) secara utuh dan mendalam guna menemukan solusi untuk masalah sosial yang terus berkembang dan kompleks. Iqbal juga melihat pentingnya mengalihkan kekuasaan ijtihad individual kepada ijtihad kolektif (ijma)’
