Avances jurídico-institucionales en materia de tráfico de migrantes en México

Migration as a social phenomenon is of great importance, as it is present in all states. Mexico is no exception, serving as a destination, return, departure, and transit country for various migration flows. This has led to the emergence and proliferation of traffickers who, taking advantage of legal loopholes and the absence of concrete government strategies, exploit migrants, reducing them to commodities while facing the indifferent gaze of authorities and the invisibility of society. The objective of this work is to analyze Mexican legislation and the public policy implemented by the current government in order to identify the progress made and the challenges that remain. The research question is: What are the legal and institutional advances in the trafficking of migrants in Mexico? The hypothesis sustained is that the advances have not been significant, despite the left-leaning orientation of the current government and their discourse on rights protection. The main conclusion reached is that the advances in combating migrant trafficking are minimal because they are aligned with the geopolitical interests of the United States rather than international commitments. This has hindered the ability to address the challenges posed by this scourge to the dignity of migrant individuals.La migración como fenómeno social cobra importancia al estar presente en todos los Estados. México no es la excepción, al ser suelo de recepción, retorno, salida y tránsito de diversas corrientes, lo que ha generado la aparición y proliferación de traficantes, quienes a la luz de los vacíos legales y ante la ausencia de estrategias gubernamentales concretas aprovechan la situación para convertir a las personas migrantes en mercancías, cosificándolas ante la mirada indiferente de la autoridad y la invisibilidad de la sociedad. El objetivo de este trabajo es analizar la legislación mexicana en la materia y la política pública implementada por el actual gobierno, con el fin de identificar los progresos realizados y los retos que aún quedan pendientes. Se parte de la pregunta de investigación ¿Cuáles son los avances jurídico-institucionales en materia de tráfico de migrantes en México? La hipótesis que se sostiene es que los avances no han sido significativos, a pesar de que el gobierno actual tiene una orientación de izquierda y un discurso de protección de derechos. La principal conclusión a la que se arriba es que los avances en tráfico de migrantes son ínfimos, porque están alineados con los intereses geopolíticos de EE UU y no con los compromisos internacionales, lo que ha impedido hacer frente a los retos que representa este flagelo para la dignidad de las personas migrantes
