The purpose of the contribution is to show the fluctuating nature of the notion of victim of human smuggling through the analysis of European and Belgian legislations and the analysis of belgian case-law. The contribution highlights the contradictions of their status by analysing migration policies and mobilising the criminological notion of the ideal victim
