O controle social das políticas públicas para a infância e adolescência : uma análise do Conselho Municipal de Direitos da Criança e do Adolescente de Natividade/RJ

This paper intends to analyze the Social Control of the Public Politics for the Childhood and Adolescence, for so much it used the Council of Rights of the Child and of the Adolescent of the municipal district of Natividade as analysis reference, investigating the space where legally they should be generated and they should be supervised the public politics through the co-acting of the public power and of the civil society, trying to discover pertinent aspects in that piece of advice that they helped or even they impeded the development of the formulation and of the social control of the politics for the childhood and adolescence. It concludes that in spite of the creation of Municipal Council of Natividade it was penetrated of relations of power of implicit and explicit domain, during a period it established reaching an apex and local and national recognition. In spite of that, the performance didn't follow a lineal development and it happened the decline as the government's privileged partner in the treatment of the public politics. With a reflection on the real possibilities of participation and social control in a country composed of polyarchy and of any-polyarchy, we noticed that this hybrid one, that it causes malicious effects in the Brazilian civic culture, it is one of the factors that impeded in the local space the participation and the social control. In compensation, we observed that in spite of the government's authoritarian tradition of our country and of the impediments for the participation and the social control, in certain times, the civilian Brazilian society knew how to organize and mobilize her guaranteeing the emergency of the legal norm of the rights of the Brazilian childhood and writing in the legislation the obligation of the establishment of responsible organs for the administration and control of the public politics, the Councils of Rights of the Child and of the Adolescent. The analyzed data allow to affirm that there is a lot of thing still to do so that the new actors included in the sphere of decision and social control, as well as the institutions new maids with the Constitution, especially the Councils of Rights of the Child and of the Adolescent, they can really accomplish the paper that destined to them.Este trabalho pretende analisar o Controle Social das Políticas Públicas para a Infância e Adolescência, para tanto tomou o Conselho de Direitos da Criança e do Adolescente do município de Natividade como referencial de análise, investigando a esfera onde legalmente devem ser geradas e fiscalizadas as políticas públicas através da co-atuação do poder público e da sociedade civil, objetivando descortinar aspectos relevantes nesse colegiado gestor que auxiliaram ou mesmo impediram o desenvolvimento dos trabalhos de formulação e controle social das políticas para a infância e adolescência. Concluiu-se que apesar da criação do colegiado municipal de Natividade ter sido permeada de relações de poder de dominação implícito e explícito, durante um período esse conseguiu se estabelecer atingindo um ápice de reconhecimento local e nacional. Não obstante, o seu apogeu não seguiu um desenvolvimento linear e ocorreu o seu declínio como interlocutor privilegiado do governo no trato das políticas públicas. Através de uma reflexão sobre as reais possibilidades de participação e controle social num país de morfologia poliárquica e não-poliárquica percebemos que esse hibridismo, que ocasiona efeitos maléficos na cultura cívica brasileira, foi um dos fatores que dificultou no âmbito local as questões relacionadas à participação e controle social. Em contrapartida, observamos que apesar da tradição autoritária do governo do nosso país e dos entraves à participação e ao controle social, em determinadas épocas, a sociedade civil brasileira soube se organizar e se mobilizar para garantir a emergência da normatização dos direitos da infância brasileira e para vincular à legislação o estabelecimento de órgãos responsáveis pela gestão e controle das políticas públicas, os Conselhos de Direitos da Criança e do Adolescente. Os dados analisados permitem afirmar que muita coisa ainda há que se fazer para que os novos atores inseridos na esfera de decisão e controle social, bem como as novas institucionalidades criadas com a Constituição, especialmente os Conselhos de Direitos da Criança e do Adolescente, possam de fato cumprir o papel a eles destinado
