Tort liability of the provider of medical services: comparative legal consideration of Greek, Ukrainian and Russian law

With this study the writer deals with an in-depth investigation of the tort liability of medical service providers is attempted through a comparative overview of Greek, Ukrainian and Russian law on this issue. The disapproval of the action and attitude of the injured party, as the basis of the tortious liability of the providers of medical services and the critical criteria for it, the intended purpose, the foundation and the analysis of the difficult issue of the violation of duties of care both in the objective as well as at the subjective level of tort liability, are some of the most basic issues that the writer deal with in this study.Με τη μελέτη αυτή επιχειρείται εμβάθυνση στην έρευνα της αδικοπρακτικής ευθύνης των παρεχόντων ιατρικές υπηρεσίες μέσω της συγκριτικής για το ζήτημα αυτό επισκόπησης του ελληνικού, του ουκρανικού και του ρωσικού δικαίου. Η αποδοκιμασία της δράσης και στάσης του ζημιώσαντος, ως θεμέλιο της αδικοπρακτικής ευθύνης των παρεχόντων ιατρικές υπηρεσίες και τα κρίσιμα γι’ αυτήν κριτήρια, ο επιδιωκόμενος με αυτήν σκοπός, η θεμελίωση και η ανάλυση του δύσκολου ζητήματος της παραβίασης των υποχρεώσεων πρόνοιας και ασφάλειας τόσο στο αντικειμενικό όσο και στο υποκειμενικό επίπεδο της αδικοπρακτικής ευθύνης, είναι κάποια από τα πιο βασικά ζητήματα τα οποία πραγματεύεται η συγγραφέας με τη μελέτη αυτή
