Foreign Experience of Operation and History of the Development of the Institute of Criminal Responsibility of Legal Entities

The purpose of the study is to establish the scope of legal regulation of the issue of criminal liability of legal entities. On September 1, 2014, the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine in Connection with the Implementation of the Action Plan on the Liberalization of the Visa Regime for Ukraine by the European Union Regarding the Liability of Legal Entities" entered into force, which was further supplemented by Chapter XIV-1 "Criminal Actions" - of a legal nature in relation to legal entities". This addition has a quasi-legal nature, since it is an indirect way of bringing legal entities to justice, but at the legislative level it has difficulties in application and interpretation, since from the very beginning the general and main principles of criminal law and the process of criminal prosecution will be violated. The category "criminal responsibility" performs an important integration function in criminal law and legislation. It is she who connects (unites) the General and Special parts, transforms their institutions and norms into organically interconnected and complementary structural elements of a single and integral system of criminal law as an independent branch of law. The problem of introducing and implementing the institution of criminal liability of legal entities is, first of all, that the introduction of such liability contradicts the general principles of the criminal law of Ukraine and requires a change in its basic provisions. It is impossible to bring a legal entity to criminal liability as a result of this person's guilty plea, as there is no sufficient and well-founded doctrine and system of criminal punishments. Organized crime, by the nature of the offense, is dangerous for citizens and the country as a whole. This can severely affect national security and the economy, if preventive and effective methods of countering these offenses are not introduced at the legislative level. In this sense, from a scientific point of view, I consider it expedient to consider the experience of foreign countries on the issue of introducing the institution of criminal liability of legal entities, what problems Ukrainian legislation faces and what are the ways to solve this problem
