Liability for Evasion of Child's Support: Criminal Law Characteristics

The article is devoted to the topic of non-payment of alimony by parents in Ukraine. The family is an important social basis for every child, it is the family that has an important impact on the child's development and on his further life as a whole. Material and spiritual support are the most important responsibilities of parents. Currently, a popular form of material support for children is alimony. This topic has gained popularity due to the fact that divorce statistics are increasing every year. It is not uncommon for people who have children together to divorce. There are many cases when individuals agree to pay financial aid for children. This fact entails the obligation of one of the parents to pay alimony. Criminal liability under Article 164 of the Criminal Code of Ukraine is provided for evasion of non-payment of alimony in Ukraine. The scientific article provides a criminal description of liability for evasion of non-payment of alimony. As well as identifying the causes and consequences of such a crime. The most common problems of children not receiving child support are unemployment of the person liable for alimony, as well as concealment of their income. In Ukraine, a popular situation is when a person hides his wealth by running a shadow business and refuses to provide a child with a minimum wage. It is the non-payment of child support that can cause many problems. It is a very common situation when a child remains dependent on one of the parents and does not receive full financial support for their development. After all, if only one of the parents provides financial support for the child's development, it entails not receiving comprehensive development for the child and dissatisfaction with the basic material conditions for the child's life. The consequence of these phenomena is psychological trauma for the child for life, as well as a negative example from an adult, which a child can copy for his life.
