ЗАХОДИ КРИМІНАЛЬНО-ПРАВОВОГО ХАРАКТЕРУ ЩОДО ЮРИДИЧНИХ ОСІБ ЯК ОДНА З МОДЕЛЕЙ РЕАЛІЗАЦІЇ ІНСТИТУТУ КРИМІНАЛЬНОЇ ВІДПОВІДАЛЬНОСТІ: МІЖНАРОДНИЙ ДОСВІД

Taking a course on reforming the domestic criminal-law system of regulation of social relations, Ukraine in 2014 introduced in the law on criminal liability the institute of criminal-legal measures against legal entities. Therefore, the solution of the problems of effective and, at the same time, affordable application of legal measures against legal entities, makes it necessary to study relevant international experience. In spite of the uncertainty of the positions in the scientific community, such a necessity of reforming the domestic system of regulation of social relations in the sphere of application of these measures of criminal legal influence, is determined both by internal (socio-economic) and external (international legal) factors. The current general list of the main models of regulation of the institution of liability of legal entities in the event of a crime makes it possible for each state to choose, based on the peculiarities of the legal system of national law. The purpose of the article is to study the international experience of criminal liability of legal entities for solving the problem of the effective application of criminal-law measures against legal entities under Ukrainian law. In general, the analysis of the main models of criminal legal influence on legal persons (on the example of certain foreign countries) gave the author the opportunity to conclude that the domestic model adopted by the legislator in the form of application to a legal entity of criminal law measures other than punishment, in their legal content is the most adapted to the principle of individual responsibility in national criminal law, since the formation of a complete crime for this model is not mandatory avoid application of criminal law for legal persons
