Implementation of Land Reform in Ukraine: Modern Environmental and Legal Realities

The article is devoted to a comprehensive analysis of the problems of environmental security in terms of land reform in Ukraine. It is established that in the current conditions of land reform implementation in Ukraine the issues of ensuring environmental safety have been left out of the legislator's attention. Particular attention is paid to the need to determine the legal basis for the preservation of the state land fund and its rational use. Emphasis is placed on the need to develop measures to increase the productivity of land use, more rational (less depleting) their use. It was found that ensuring environmental security in the implementation of land reform is the key to comprehensive protection of the right of citizens to own, use and dispose of land, the right of citizens to a safe environment for life and health. It is stated that despite the real steps to revise the regulatory framework for land use in Ukraine, many problems of administrative, administrative and legal nature regarding the implementation of land reform remain unresolved. They relate to the lack of mechanisms for state control over compliance with environmental safety requirements in the process of exercising ownership of agricultural land, overcoming corruption in this area, the imperfection of the land market management mechanism; lack of proper management of environmental risks associated with the implementation of land ownership; insufficient institutional separation of the subjects of implementation of control powers in the field of agricultural land use. Reforming the legal basis for the implementation of environmental policy during the implementation of land reform is also associated with the strengthening of administrative and legal liability for environmental offenses in the field of agricultural land use. We should look for new legal resources, legal means to overcome the negative trends in the field of ownership of agricultural land
