SUBJECTIVE SIDE OF THE CRIME OF COERCION TO MAKE STATEMENTS

In the publication the subjective side is examined as a constituent element of the criminal coercion to make statements, this represents the inner side of the crime. The subjective side of the crime of coercion to make statements includes the three signs characteristic, the main one - guilt and two optional signs - purpose and reason. The reason is the conclusion about the commission of the analyzed crime with guilt that is expressed in direct intent .The purpose and reason for the commission of the crime under analysis are assessed as optional signs, which are to be taken into account when individualizing the punishment. In the article is also undertaken ananalysis of doctrinal opinions on the subject under investigation
