The Right to Freedom of Expression as a Means of Controlling Power in Democratic States

The article deals with the issues of the current state of normative-legal regulation, as well as the practice of preventing the restriction of the right to freedom of expression. Based on the analysis, the specifics of world practice have been identified, cases of limiting the right to information have been highlighted, examples of countries that refuse to introduce such mechanisms are presented. Attempts to restrict freedom of expression, the freedom of their free circulation and access to them in areas relating to power may indicate that the political regime is not democratic but is created only as a means of forming a positive international and national image of the country. The result of such events is the weakening of public control over the exercise of state power by central authorities and officials. The scientific study contains a number of proposals for improving the right to freedom of expression and the impossibility of cases of restrictions on the lawful use of proposals. The issues of freedom of expression on the Internet are also considered, and special attention is paid to civil society as a mechanism for monitoring the activities of the authorities. The scientific article corresponds to actual problems of the present and indicates the methods of solving these problems. The practice of the European Court of Human Rights is analyzed and its positions are taken into account in accordance with the tasks set.
