Renewable energies and the legal regime of contracts for wind power generation in Brazil

The Brazilian energy matrix stands out compared to the rest of the world due to the relevant participation of renewable energy sources. The production of renewable energy in Brazil has been concentrated in four sources: hydro, biomass, wind and solar. Currently, wind farms and photovoltaic plants have been gaining importance, representing together in 2022 15.02% of power generation (ANEEL, 2022). In both cases the appropriation of vast areas is essential for energy production to occur. Due to the lack of specific regulation land access has been taking place through land lease agreements and contracts for the assignment of land use, traditionally used in Agrarian Law. In order to reveal the consequences, impacts, contradictions and problems arising from this adaptation of the agrarian contract regime to renewable energy production in Brazil, especially wind energy, we will present a brief analysis of 22 contracts to which we had access until 2018.
