Legal Regulation of Women's Work Modern Condition and Motherhood Legal Protection

This article is devoted to the disclosure of labour legislation in the field of legal regulation of women's work and motherhood protection, clarifying the main problems in this area and identifying possible ways to solve them. Discrimination against women also occurs in labour law, for instance, at employment, wage and maternity protection. This can be explained with the imperfection of labour law, non-compliance by employers with the norms on providing labour benefits and guarantees for women's work, legal protection of motherhood. It is important to notice, that constant trends, traditions and public perceptions of the place and role of women in life become a great barrage on the way of providing equality between women and men. At present, Ukraine seeks rapprochement with the European Union, so the first priority has been to sign international agreements governing discrimination, equality of women, and maternity protection. However, a critical issue for Ukraine remains that the norms declared on paper do not find their application in practice. The author consider the legal regulation and constitutional principles of women's labour and legal protection of motherhood in Ukraine. A fundamental normative legal act designed to regulate labour relations, the Labour Code of Ukraine. A more detailed legal regulation of women’s work is given in Chapter XII of the Labour Code of Ukraine with the name “Women’s work”. In particular, this chapter contains a system of legal guarantees for the realization of women's labour rights, which is designed to reduce and eliminate the number of cases of violation of women's labour rights and ignoring their legitimate interests. The formation, current state and prospects of development of women's labour institutions and legal protection of motherhood according to the labour legislation of Ukraine are characterized.
