The legislation called transplantation of human organ act (THO) was passed in India in the year 1994. In the rules has been accepted brain death as a mode of death and sale of organ is a punishable offence where still now many cases are reported of organ transplant. Through section 9(3) of THO, it is mentioned unrelated donor can donate their organ through signing in a consent form and the scandals are happening based on this. THO has undergone major and minor changes in the form of addition of rules and amendments in order to improve the acts to make it much acceptable legally.
