ABSTRACT. The problem of medical errors is specific to the legal liability of medical workers, providers of medical and pharmaceutical services. There is no single view in the literature on the qualification of medical errors. From a legal point of view, it is necessary to distinguish between medical error and criminal error. The delimitation of these qualifications may facilitate the establishment and legal consolidation of the concept of medical error and malpractice in national law. Using new European legal and educational approaches to tackling medical malpractice will minimize the risk of citizens' rights being violated when providing healthcare, and will protect doctors against unfounded patient allegations
