СУЧАСНІ ТЕОРЕТИКО-МЕТОДОЛОГІЧНІ ПІДХОДИ ДО ЗМІСТУ ПРАВОВОЇ ІДЕОЛОГІЇ

The article analyzes the main theoretical and methodological approaches to the understanding of the content of legal ideology. Following the evolution of the main stages of scientific thought regarding the understanding of ideology. The source of legal ideas is the political and legal, socio-economic reality and practical activities of people in the process of which legal ideas and related socio-political demands develop and transform, concentrating the results of legal practice. Legal ideology is defined by the mode of production not directly, but indirectly, through legal, political and ideological relations. The basic prerequisites for the emergence of a legal ideology that is not possible without the existence of the state or a clear concept of state-building are established. In the structure of legal ideology, the fundamental, conceptual-program, professional-legal and everyday levels are allocated. It is determined that for the legal ideology characteristic purposeful scientific comprehension of law is not at the level of its individual manifestations, but as a holistic phenomenon, which has its own value. The need for ideology is laid down by the very regularity of the functioning of society and by the necessity of finding nationwide spiritual references capable of consolidating society. Legal ideology begins with ideas, acts as their system, though not limited to them. It reveals the functional purpose of ideas, possibilities and features of practical implementation of their transition to other structural components. The main features of legal ideology are systemic, spiritual and practical, content and functional aspects. The meaningful aspect of ideology is based on the diversity of the public interests of those involved in or applying for government participation. In ideology, how much does the concept of state and law unfold, how much state power in this society is fixed. It is concluded that the main feature of legal ideology is the formation, updating, direction, structuring and justification of certain methods or directions of certain activities and condemnation of others. Within the framework of ideology (ie, in the context of awareness of people's own attitude to reality, as well as the essence of social problems and conflicts), there are goals and programs of active activity aimed at consolidating or changing existing social relations. The conclusions established that the formation of legal ideology is always connected with the spiritual life and activities of the whole society and the state, and its content is determined by the peculiarities of the legal family (historical, structural, types of legal thinking), the historical period and the type of culture to which it belongs one or another legal system. Legal ideology is the form through which society can perceive and assess the doctrinal and dogmatic construction of the legal community. For the effectiveness of legal ideology, it is not enough simply to formalize certain ideas in formal sources of law. It is necessary that legal ideas really exercised their influence on the consciousness and behavior of the subjects of the legal system through the establishment and updating of a complex of values, the formation of representations of the appropriate orientation of legal behavior. Undoubtedly, a new ideology requires a lot of time both for its formation and for its propaganda. Developed legal ideology can raise the prestige and significance of law as a social regulator in the public consciousness and thus contribute to more civilized forms of resolving social conflicts. Although the modern stage in the development of theoretical jurisprudence is characterized by increased attention to the problems of the nature of ideology, the ideological function of legal knowledge, the importance of state ideology for the development of society. It should be noted that there is still no generally accepted understanding of the essence of legal ideology, the development of the notion of legal ideology, its connection with related theoretical concepts, the substantiation of the fundamental differences between the legal ideology and the ideology of the political (state)
