The application process of international law in solution of territorial conflict of the Republic of Moldova and Georgia

The article reflects the application process of international law in solution of territorial conflicts of the Republic of Moldova and Georgia. The regime of international humanitarian law offers a certain level of protection for population, prosecuting alleged offenders for war crimes, such as rape, murder and torture, protecting civilian assets. However, the potential level of protection depends on the classification of the conflict. There is analyzed the subject regarding applicable jurisdiction to members of the Russian Federation’s armed forces allocated on the territory of the Republic of Moldova as a current one for public international law. What about the Georgia, this country appealed to the principle of territorial integrity, while South Ossetia appealed to peoples’ right to self-determination. As a result of the armed attack on South Ossetia, Georgia violated the principles of international law, namely: prohibition of the use of force or threat of force, respect for human rights and fundamental freedoms, as self-determination of the peopl
