COMPARATIVE CHARACTERISTICS OF THE CIVIL PROCEDURAL LEGISLATION OF THE CIS COUNTRIES ON THE QUESTION OF JUVENIAL JUSTICE

The article presents the results of the analysis and the state of the current legislation of the CIS countries in the field of juvenile justice. The scientific literature, national and foreign legislation are analyzed. This led to the following conclusion: the consideration of civil cases involving minors is a new area, insufficiently developed and requires more thorough study by scientists and government bodies; having secured the status of an independent subject for minors, civil procedural legislation should review its interaction with minors through their legal representatives; if, upon reaching the age of 14, a person is recognized as capable of independently being responsible for the losses and harm caused, as well as being liable under administrative and criminal legislation for certain types of offenses and crimes, then we consider it appropriate to reconsider the issue of the scope of civil procedural capacity of a minor; legislation should develop along the way when a minor is an active participant in procedural relations.
